JpMorgan Case Essay

We trust banks to hold our money and to help make use get more in investment and other ways. One of the most trusted banks is J.P. Morgan Chase they are easily one of the most well-known banks that exist. J.P. Morgan Chase on May 10, 2012 disclosed that they had lost more than $2 billion by trading financial derivatives. The administrative agencies like the Securities and Exchange Commission (SEC) or the Commodities Futures Trading Commission (CFTC) take action in order to be effective in preventing high-risk gambles in securities and banking, a foundation of the economy. We have to understand the elements of a valid contract, and discuss how consumers and banks each have a duty of good faith and fair dealing in the banking relationship. Having to compare and contrast the differences between intentional and negligent tort actions. I’ll discuss the tort action of â€Å"Interference with Contractual Relations and Participating in a Breach of Fiduciary duty† and, if the bank I’ve chosen were to behave as JP Morgan did, would I be able to prevail in such a tort action. Lastly let’s discuss how banks have protected the software that allows for online transaction to occur through automation.7 The U.S. Securities and Exchange Commission (SEC) is a federal agency. It holds primary responsibility for enforcing the federal securities laws and regulating the securities industry, the nation’s stock and options exchanges, and other electronic securities markets in the United States. The SEC is divided into four divisions; The Division of Corporation Finance; the Division of Trading and Markets; the Division of Investment Management; and The Division of Enforcement. All the branches within the SEC carry similar  goals in terms of protecting individuals and ensuring financial fairness, each has their own specialty for instance, the Division of Corporate Finance is tasked with the assurance that all imperative disclosure of which represent a corporation are easily accessible by the general public. In addition, the Division of Trading and Markets ensure fairness, order and efficiency in market activities. Much like the design of the SEC, the Commodity Futures Trading Commis sion (CFTC) is also inherently designed to ensure the public, its consumers, and investors are protected from coercion, manipulation, fraud, and/or any other forms of dishonest dealings between manufacturer and consumers/investors. The CFTC is noted to be an independent federal agency established by the Commodity Futures Trading Commission Act of 1974. Again, similar to the design of the SEC, the CFTC is comprised of five different committees, each of which are responsible for a different area of trade and marketing; for example, agriculture, global markets, energy and environmental markets and technology all of which are equally as responsible as the next for ensuring full cooperation and adherence to laws set forth by the SEC. Though banking is the most common method in which most people handle and maintain their finances, there are also equally as many that take their money to invest in stocks, bonds, and the like which do not carry a sound guarantee that they will make a profit or even keep their initial investment monies. Consequently, past dealings with investor types result in unfair and fraudulent losses and even erroneous gains such as the ones reported by JP Morgan Chase, the purpose of the SEC and CFTC alike become abundantly clear. With the utilization of these two particular securities, investors, consumers, and even marketers are able to rest easier knowing that there are serious legal, unfair and blatantly dishonest dealings within the marketplace. In an effort to maintain honest correspondence and dealings with the capital market, both of these require that all earnings and losses should be reported; at which point, there can be a recognition and determination of any imbalanced and deceitful dealings having taken place. The following are the essential elements of a valid contract. Offer and Acceptance. In order to create a valid contract, there must be a ‘lawful offer’ by one party and lawful acceptance of the same by the other party  Intention to Create Legal Relationship. In case, there is no such intention on the part of parties, there is no contract. Agreements of social or domestic nature do not contemplate legal relations. Lawful Consideration has been defined in various ways. The parties to an agreement must be competent the contract. If either of the parties does not have the capacity to contract, the contract is not valid. Free Consent’ means the parties must have agreed upon the same thing in the same sense. In the banking context, this means among other things that a bank could call a loan, refuse to fund, refuse to roll over a loan, set off accounts, etc., no matter how drastic the consequences might be to the borrower. As long as the banks accept them expressly wit hin the granted rights under the controlling loan documents. That may no longer be the case. The first area, financial accounting, is used mainly for ascertaining the results of any such business on a periodic basis. Other key factors could be supply, demand, competitors, availability of raw materials, logistics etc. The second area is cost accounting, its primary purpose is to attain the value of direct and indirect costs involved in production. The value acquired, management can make an informed decision on improvement in production performance. From an economic perspective, cost accounting is the measurement of economic performance. This information gives management a clearer indication of the performance of the product resources in the business. Costing also helps the sales manage in setting the correct price. But, because costing is solely a measurement of economic performance, it can’t be considered as an accurate basis for setting prices. Selling prices is more of an economic decision it would not be wrong to mention that pricing is basically determined by market  factors. Prices are influenced mainly on demand, supply and competition, less on costs. High demand plus lack of competition would result in the business charging higher prices for its product, well above the costs. The third area is management accounting, which is related closely to cost accounting. It has evolved from cost accounting; management accounting plays a much broader role in management decisions. It measures the performance, economically, of the whole business, the economic environment that the business operates in. This area of accounting, seeks to combine both financial and cost information into a much broader function. Compare and contrast the differences between intentional and negligent tort actions. Intentional torts and negligence towards both give rise to civil actions. However, there are some important differences to understand about negligence versus intentional torts. Negligence torts do not require intent. To determine if someone should be found liable for a negligence tort, a reasonable person standard is used. If the defendant’s behavior is found to be less careful than behavior a reasonable person would exhibit, that defendant can be found liable for damages. Intentional torts require intent. The person who committed to tort must have intended to cause harm. The harm, however, did not need to be the specific type of harm that was caused to you. The other major difference between intentional and negligence torts, aside from the standard of proof, is that in many cases, a person who is found liable for an intentional tort can be required to pay punitive damages in addition to actua l damages. Discuss the tort action of â€Å"Interference with Contractual Relations and Participating in a Breach of Fiduciary duty† and, if the bank you’ve chosen were to behave as JP Morgan did, would you be able to prevail in such a tort action. The tort of interference with contractual relations and participating protects the right to enjoy the benefits of legally binding agreements. I have chosen a bank like JP Morgan and they did what he I would not took it very well. I invested money and knowing that JP losses that money I would wind up probably suing them. But providing a remedy when the defendant intentionally induces another person to breach a contract with the plaintiff. The defendant must know of the existence of the contract between the plaintiff and the other person, or there must be a sufficient fact that a reasonable person would be led to believe that such  contract existed. Interference with the contractual relations requires an unacceptable purpose. If good grounds are set and exist for the interference then the defendant is not liable. But as for J.P. Morgan there were no good rounds so the defendant is liable. So if I were to go to court over this I would not win and neither would J.P we would just be both out of the loss money that was invested. In conclusion when you invest money in a bank Think to you self is it a good idea or is it not a good idea. We all make investments just need to make sure it in the right bank that you can trust. Often these courts would be engaged in fact finding since they are not expected to hear full legal arguments of the parties. It brings out The Weekly Law Reports and The Law Reports. The decisions that are taken as legal precedents shall have 'ratio decidendi' behind them. The ratio decidendi must be related to the law and not on factual findings. It can not also be 'obiter dictum' mentioned as a passing reference while deciding the case and shall have no legal basis for future decisions. The ratio which is binding shall have legal principles and rules considered for finding a solution for the problem in the case. The 'obiter dicta' however are treated as persuasive authority which later judges can use them for arriving at their decisions but are not bound to treat them as precedents.(UK law online) Precedent has a very important role in the common law. It ensures certainty and consistency and logical progression and development in the law. At the same time it can be rigid and also complex - what is "the law" on a subject may be very difficult to find or to state as it is spread across many cases. So, many countries (especially in Continental Europe) prefer a codified system in which laws are set out in legislation and cases which apply them may be illustrative but do not become binding. The law is also easier to find and to state and is rationally prospective rather than based on the chance event of litigation, which may give rise to laws based on extreme or unusual situations or unevenly argued cases. For example, here is the offence of murder in US Federal Law. By contrast, the law of murder in England is contained in several cases, and even having read them there may be room for doubt. As for English law, the classic definition of murder is considered to be that given by Lo rd Chief Justice Coke who (writing in the early seventeenth century) said: "Murder is when a man of sound memory and of the age of discretion, unlawfully killeth within any county of the realm any reasonable creature in rerum natura under the King's peace, with malice aforethought, either expressed by the party or implied by law, so as the party wo, or hurt etc. die of the wound or hurt etc .within a year and a day of the same." But in those areas where deterritorialization and social interconnectedness across national borders are especially striking, new transnational institutions (for example, cross-border referenda), along with a dramatic strengthening and further democratization of existing forms of supranational authority (in particular, the United Nations), are necessary if we are to assure that popular sovereignty remains an effective principle. Globalization guarantees sustainable competitiveness through leadership of technological improvements.   The attraction of many countries in need of investment has promoted the growth of economies in most countries that embrace globalization.   Good examples are the recent joint ventures of China with Japanese companies where the Chinese get skills directly by working the Japanese. High-speed technologies and organizational approaches are employed by transnational operating firms, the so-called â€Å"global players,† with great effectiveness. The emergence of â€Å"around-the-world, around-the-clock† financial markets, where major cross-border financial transactions are made in cyberspace at the blink of an eye, represents a familiar example of the economic face of globalization. (Mark Interline 2001) How Philippines is integrated in international economy at the global community. Philippines as far as the globalization is concerned is rated in the semi-globalize world.   The country has not achieved completely what it takes for a country to be globalized.   It is lacking integrated markets and economies with other countries.   This because it has not taken advantage of across borders integration.   Low cross borders coordination reduces the economic share activities which have an effect of reducing fast economic growth.   Philippines have now a new political shift aimed at promoting its economic growth.   One of the main issues of promoting globalization is through democratization.   This is an aspect that has been missing in Philippines, there is a tendency the country believing that poor countries should not depend on the foreign capital and for this reason the country believes in regional issues of development. Philippine is the latest country to be accepted in the global alliance nations sharing global information and economies.   The country’s software sector has greatly grown giving it advantage in global information technology.   In the year 2006, Philippines had established software innovation which aimed at creating a global centre of information.   The process of software innovation is based on good relations with other countries that have advanced technology.   This procedure has promoted individuals business within the integrated countries.   A good example is stag Philippines Company that developed an innovative online registration system for one of the domestic airlines, this is a positive movement towards globalizations. The country has moved from the traditional of doing things to the scientific and technological revolutions.   Philippines has achieved great integration in East Asia with countries such as Indonesia, Malaysia and Thailand.   This form of regional integration has promoted free market within the area hence improved economies. Globalization refers to increased possibilities for action between and among people in situations where latitudinal and longitudinal location seems immaterial to the social activity at hand. Even though geographical location remains crucial for many undertakings (for example, farming to satisfy the needs of a local market), deterritorialization manifests itself in many social spheres.. Territory in the sense of a traditional sense of a geographically identifiable location no longer constitutes the whole of â€Å"social space† in which human activity takes places. In this initial sense of the term, globalization refers to the spread of new forms of non-territorial social activity (Fred, 1998) There are great challenges for the government in trying to harmonize governance especially when there is integration of business bodies with other countries.   The process of liberalization and democratization enables the more advanced countries to take advantage of the free market.   The more developed countries use this opportunity in getting more profits which they take to their rich countries.   There is power mixing for the government as it not possible to control all the power diffusion. Each manifestation of globalization also generates distinct conflicts and dislocations. For example, there is substantial empirical evidence that cross-border flows and exchanges, as well as the emergence of directly transnational forms of production by means of which a single commodity is manufactured simultaneously in distant corners of the globe, are gaining in prominence (Castells, 1996). The whole process of Philippines involvement in international and global community is that the developed countries in term s of service provision on the onset there is un equal competition for the integrated market which the developed countries stand a better chance to exploit.   Despite the lower levels of poverty in most states, there is a general inequality in the overall income among the citizens. The inequality in Philippines occurs especially between rural and urban areas.   This has led to economic stagnation and civil instability which threatens the goal of reducing poverty by globalization.   Other places are overpopulated causing strain on the meager natural resources.   The fact that Philippines has moved global has not solved the internal disparities which threaten to increase poverty levels. The government has a great challenge of implementing certain agreements with the international community.   Such international conventions are so demanding in terms of implementation within the country.   When these legal conventions are integrated to the country they have the capacity to weaken the internal structures of the country. As an empirical matter, the decay of the domestic-foreign frontier seems highly ambivalent, since it might easily pave the way for the decay of the more attractive attributes of domestic political life: as â€Å"foreign† affairs collapse inward onto â€Å"domestic† political life, the relative lawlessness of the former potentially makes disturbing inroads onto the latter (Scheuerman, 2004) The government is also challenged by the rapidly expanding flow of goods services information and people which makes the country to be more interdependent.   This requires that the country sets global consensus to meet these challenges. Globalization-from-above is controlled by wealthy elites and driven by a hunger for more wealth and power. But there is another form of globalization in the Philippines that is made up of grassroots alliances of human rights activists, trade unions, womens organizations, and environmental coalitions and farmers’ organizations. This form of globalization however does not get as much publicity as the elite form of globalization but it is growing just as rapidly. The institutions such as the World Bank, the International Monetary Fund and transnational corporations have assisted in development and the integration of the world’s countries into the global system. The cross-boarder issues that require joint efforts have been very difficult for the Philippine government to manage.   Areas that require regional cooperation include drug supply reduction, prevention of HIV/AIDS, fight against illegal drugs.   Lack of such support has been a great set back to the government. Critics insist that local, regional, and national forms of self-government are being rapidly supplanted by insufficiently democratic forms of global governance remote from the needs of ordinary citizens, whereas their defenders describe new forms of supranational legal and political decision as indispensable forerunners to more inclusive and advanced forms of self-government. Global financial markets also challenge traditional attempts by liberal democratic nation-states to rein in the activities of bankers, spawning understandable anxieties about the growing power and influence of financial markets over democratically elected representative institutions Globalization has an effect on Philippines culture and traditions as the society’s norms and values as subject to change.   There are many ways in which the globalization may finally erode the cultural values of the people due to the volatile socialization a contribution of market liberalization and democratization. Market liberalization and the democratization has continued to adversely contributed to the deceleration in growth rate of the country because of the worsening terms of trade between the integrated countries and Philippines. There is a weak growth of exports to the developed countries but rather there are a big number of imports to the country. This means that the country spends more money to the outside countries than what it receives.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   There is a need for the developed countries to have a positive shift towards assisting the developing countries. This can be done by the removal of trade barrier to the developing countries. Philippine’s economy has been growing at 4-6% GDP due to the growth of the robust sector. Electrons and semiconductors contribute greatly to the country’s exports. There is variety of market for the Philippines products due to the globalization. A global citizen in this country is encouraged to participate actively by taking advantage of the available opportunities: outsourcing is an outcome of technological advancements. For instance, many people in the Philippines start their work at 9pm till five in the morning. Such jobs include call centers. This industry of out sources is growing at 57%per year. The Philippines has low or more open economy, a contribution of the economic reforms done as well as moving global. The linking together and expanding of social activities across borders is predicated on the possibility of relatively fast flows and movements of people, information, capital, and goods. Without these fast flows, it is difficult to see how distant events could possibly posses the influence they now enjoy. High-speed technology plays a pivotal role in the velocity of human affairs. The current crop of politicians believes that the future of the country depends on global connectivity and it is for this reason they support global dynamics and global competitiveness. The democratic model has been used in Philippines in the process of creating alliances with other countries. According to one influential strand within international relations theory, relations between states are fundamentally lawless. Since the achievement of justice or democracy, for example, presupposes an effective political sovereign, the lacuna of sovereignty at the global level means that justice and democracy are necessarily incomplete and probably unattainable there. In this â€Å"Realist† view of international politics, core features of the modern system of sovereign states relegate the pursuit of western political thoughts most noble normative goals primarily to the domestic arena. Other critics has that the dangers of global economy is that investors come into a particular country, present certain conditions and government often accept them without asking the people who will be affected, which is a violation of workers rights. It often happens under such deals when state companies are bought over by foreign companies, thousands of workers are laid off under so called structural adjustment program to cut the cost, while workers are pushed for longer hours and prohibited from labor unions. The whole purpose behind this way of working is exploitation of the foreign market to gain greater profit. Globalization is part of the changing world, but the way it is coming in developing countries lacks humanity. Contemporary analysts associate globalization with deterritorialization, according to which a growing variety of social activities takes place irrespective of the geographical location of participants. As Jan Aart Scholte observes, â€Å"global events can via telecommunication, digital computers, audiovisual media, rocketry and the like occur almost simultaneously anywhere and everywhere in the world. (Scholte Aart, 1996) In conclusion globalization is the way forward for Philippine’s economic and political growth. Technology is the key to the achievement of the globalization process and it is therefore very important for any country to embrace technological changes in order to be complacent with the fast changes in the world. A country that will not embrace technological changes is like lag behind in matters of development. Increased communication is panacea of any expanding economy as this promotes sharing of the international nature. Expanding free market promotes greater exchange of skills which has a net effect of improving the economy in terms of the factors maximizing the factors of production such as capital, land, entrepreneurship. Outsourcing is the contemporary form of globalization that is practiced in the contemporary Philippine and this has led to the improved social relation among the regional countries. Integration of different companies which produce similar products has enhanced the exchange of technologies by the virtue of direct contact. Finally globalization has reduced the social boundaries as well the geographical barriers and now people are staying as one big community. History of Civil Rights | Essay Racism entails the belief that some races are more superior to others in society. From as early as the colonial era, racism in the United States of America has been a major issue. Native Americans, African Americans, Asian Americans, Mexican Americans, American Jews, Irish Americans and some other immigrant groups and their descendants were all considered as the minority groups. Racism has many forms. However, no one is born a racist. This develops from the environment from which our children grow into. Racism in the United States of America has been a major issue ever since the slave and the colonial era. Legally endorsed racial discrimination imposed a grave burden on African Americans, Native Americans, Mexican Americans, and Asian Americans. European Americans were from the beginning at an advantage since the American law favored them in matters of voting rights, literacy standards, immigration, land acquisition, citizenship, and criminal procedure over periods of time extend from as early as the 17th century to the 1960s. Majority of the European ethnic groups, particularly Eastern Europe, Irish Americans, American Jews, Southern European immigrants, in addition other immigrants, suffered discrimination and other kinds of racism in American society. The major racially structured institutions at the time included Indian wars, slavery, segregation, Native American reservations, internment camps and residential schools (for Native Americans. In America, official racial bias was largely prohibited in the mid-20th century; moreover, it came to be viewed as socially intolerable. However, racial politics remained a major phenomenon in American territory. Historical racism up to date has continued to be perceived in socio-economic inequality. Nevertheless, racial stratification continued to take place in all avenues in our society including government, housing, employment, housing, lending and education sectors. As is the case in most countries, many people in the United States of America continue to harbor some discrimination against individuals from other races. Discrimination infiltrates almost all aspects of life in the United States of America, and it further extends to all communities of color. SLAVERY Slavery in the United States was a kind of forced labor that existed in North America as a legal institution for over a century. This was before the United States was founded in the year 1776. Later on, slavery began to spread to the south. This continued until the thirteenth Amendment of the United States Constitution was passed in 1865. The first lot of Africans to land in the United States was brought into North America in 1619. The ship docked in Virginia carrying about 20 Africans. This was the beginning of slavery in America. Slavery gradually spread into areas with good fertile soils where large plantations of high value cash crops were being grown. The key crops being grown were sugar, Cotton, coffee and tobacco. During the 18th century, legislatures and colonial courts had radicalized slavery. Fundamentally this created a caste system in which slavery applied exclusively to Black Africans and other people of African origin. However, Native Americans were also occasionally turned into slaves. Between the 16th à ¢Ãƒ ¢Ã¢â‚¬Å¡Ã‚ ¬ 19th centuries, more than 12 million Africans had been shipped into America to become slaves to the Americans. By the 19th century, majority of the slave holders were located in South Americas where the land was more fertile. The African slaves were managed by overseers who were usually white Americans. Slavery was a touchy subject in the politics of the United States of America between 1770s-1860s. Thus it became a matter of discussion in the drafting of the American Constitution. Moreover, it became a key issue in Federal legislation and Supreme Court cases. Slaves resisted the legalization of slavery and the whole institution that supported it. To show their dismay, they held rebellions and non-compliance. In addition, they escaped slavery by travelling to non-slave states and Canada. This was made possible by the Underground Railroad. Activists of abolitionism were constantly engaged in political and moral debates in an effort to encourage the creation of Free Soil states as Western expansion proceeded. Slavery was a major subject that led to the start of the American Civil War. Once the Union won the war, slavery became illegal throughout the United States of America. In addition, the country adopted the Thirteenth Amendment to the United States Constitution. B. Freedom Fighters Once slavery was abolished, African American people began to rise into positions of power in America. Some of them are discussed below. Martin Luther King Jr. Martin Luther King, Jr was not only an American clergyman and activist but also a prominent leader in the African American Civil Rights Movement. He is famous for his contribution to the advancement of civil rights in the United States and around the world. He advocated for the use of non violent methods with regards to Mahatma Gandhi. He is also famous for being a Nobel peace laureate in 1964 for his work to end racial segregation and discrimination using non violent means. When he was assassinated in 1968, he was posthumously honored the Presidential Medal of Freedom. This was in 1977 and in 2004; he was awarded the Congressional Gold Medal. In the year 1986, Martin Luther King, Jr. Day was established as a U.S. federal holiday. 2. Autherine Lucy Foster Autherine Lucy Foster went down in history as the first black student to ever attend the University of Alabama. At the time, university policies prohibited her from attending the university since she was black. She therefore approached the National Association for the Advancement of Colored People (NAACP) for assistance. Court proceedings began on July 1953 and on June 29, 1955, the NAACP secured a court order preventing the University from turning down the admission applications of Lucy and her friend based upon their race. Few days later, the court amended the decision to apply to all other African-American students who were seeking admission in the university. The Supreme Court upheld this in Lucy v. Adams on October 10, 1955. The university reluctantly allowed Lucy to register, however, she was excluded from all dormitories and dining halls. On February 3, 1956, Lucy enrolled as a graduate student in library science, becoming the first African American to ever get admitted to a w hite public school or university in the state. However, things were not smooth sailing for Lucy since on the third day of classes, a hostile mob gathered to keep her from attending her classes. The police intervened however that evening Lucy was suspended from university on grounds that she disrupted the peace in the university. She filed suit against the university and as a result, they expelled her on grounds that she slandered the university reputation after decades of law suits, the University overturned her expulsion. This was in 1980, and in 1992, she finally earned her Masters degree in Elementary Education from the University. The University named a scholarship in her honor as well as unveiled a portrait of her in the student union. The inscription on it reads Her initiative and courage won the right for students of all races to attend the University. 3. Ida B. Wells- Barnet Ida Bell Wells-Barnett (July 16, 1862 March 25, 1931) was an African American female news paper editor and journalist. Her husband, Ferdinand L. Barnett, was the newspaper owner as well as an early civil rights movement leader. Ida documented the extent of killings that were being executed in the United States. She was also dynamic in the womens rights movement as well as the womens suffrage movement in America. Since she was little, she was aggressive in her demands for equality and justice for African-Americans. She always maintained that the African-American community could only gain justice through its own determination and efforts. Since her death, in March 25, 1931, the significance of her life as well as her legacy has greatly grown. Her life story has been the subject of a extensively performed musical drama, which debuted in 2006, by Tazewell Thompson. In history, she is labeled the woman who was at one time born in slavery yet she grew to overcome all odds and become one of the great pioneer activists of the Civil Rights Movement in America. III. Civil Rights Movements in the United States Brown vs. Board of Education Brown v. Board of Education of Topeka was a land mark decision made by United States Warren Supreme court on May 17, 1954. The land mark declared the previous state laws that ensured the establishing separate public schools for white and black students were unconstitutional. This court ruling overturned the Ferguson vs. Plessey decision of 1896 which advocated for state-sponsored segregation. The court decision stated that separate educational facilities are inherently unequal. As a result, de jure racial segregation was declared a violation of the Equal Protection Clause of the Fourteenth Amendment of the United States constitution. This ruling paved the way for integration of all people irrespective of their race and civil rights movement. B. Harlem Renaissance The Harlem Renaissance began as a result of changes that had occurred in the African American community since slave was legally abolished. These changes were further hastened by the outcome of World War I. another catalyst to the movement was the great social and cultural changes that occurred in early 20th century in the United States. Industrialization was attracting people to urban areas from the rural areas and as a result, this gave rise to a new mass culture. Some of the contributing factors that lead to the Harlem Renaissance were the First World War, which had produced new industrial employment opportunities for hundreds of thousands of people and the Great Migration of African Americans to northern cities in America. This in turn led to the concentration of ambitious people in areas where they could hearten each other. Thus, the movement emerged stronger and more determined than ever. Harlem is a section of New York City. In the early 1900s, mostly in the1920s and early 1930s, African American literature started to thrive in Harlem. The New Negro movement, the New Negro Renaissance, and the Negro Renaissance were names referring the African American movement that was aimed at fighting for the blacks rights in America. This movement came forward towards the end of the First World War in 1918. The Harlem Renaissance marked the crucial moment in American history when the mainstream writers and critics took African American literature seriously. This is because; they realized that African American literature and arts was gaining significant attention from the world as a whole. Although it was mainly a fictional movement, it was very much related to progress in African American theater, music, politics and art. The Harlem Renaissance seemed to be the best of times for America to recognize and appreciate the African American people. The Harlem renaissance main objective was to fight for equality. However, once the great depression came about, the Harlem renaissance collapsed. Conclusion The election of Barrack Obama as a US president was a major milestone in the history of the United States. Being an African American, it was the peoples way of telling the world that the end of the dark ages of racism in America had come. People like martin Luther King Jr. dreamt of the day all Americans would accept each other and learn to live together in harmony. Finally this dream is slowly becoming a reality. Racism is a global harm on society, yet with persistence equality can be made.

Political Correctness Infringes on our First Amendment Rights Political correctness has become increasingly obvious in our daily lives. For example, the other day I attended the first meeting of the Frisbee Club here on the State University campus. During the meeting, we were discussing the fact we wanted shirts for this year, but we did not know what slogan to use. While in the brainstorming process, the slogan â€Å"Suck my disk† came out. At the time, the slogan â€Å"suck my disk† seemed to be better than sliced bread to a bunch of college guys. But as we were wrapping up the meeting, one person came out and asked, â€Å"How appropriate do you think this slogan is if we want to have a Frisbee clinic with the high school? I think parents will be a little apprehensive.† It was also brought to our attention that Silk Screen, the local store that prints different images and slogans on clothing, has a policy that refuses politically incorrect slogans.
